Welcome to Culturoot International. By accessing our website, requesting quotations, placing orders, or using our services, you agree to the following Terms and Conditions.
1. About Us
Culturoot International is an India-based export and sourcing company connecting global buyers with trusted Indian manufacturers across multiple product categories including construction materials, apparel, handicrafts, furniture, home décor, machinery, bags, spices, and other products.
2. Product Information
We strive to ensure that all product descriptions, specifications, images, and pricing information are accurate. However, due to manufacturing processes, natural materials, handmade production techniques, and screen display differences, slight variations may occur.
Product images displayed on the website are for reference purposes only.
3. Quotations and Pricing
All quotations are subject to change without prior notice unless otherwise agreed in writing.
Prices may vary based on:

Shipping method

Currency fluctuations

Raw material costs
A quotation does not constitute a binding agreement until confirmed by both parties.
4. Payment Terms
Unless otherwise agreed in writing, the following payment terms shall apply:

50% Advance Payment upon order confirmation.

50% Balance Payment before dispatch of goods.

Production or sourcing activities will commence only after receipt of the advance payment.

Shipment documents shall be released only after receipt of full payment.
Culturoot International reserves the right to suspend production, dispatch, or delivery in case of delayed payments.
All banking charges, intermediary bank fees, and transfer costs shall be borne by the buyer.
No goods shall be dispatched without receipt of 100% payment unless separate credit terms have been agreed in writing.
5. Incoterms
All international shipments shall be governed by the latest version of Incoterms® published by the International Chamber of Commerce (ICC).
Depending on the agreement between buyer and seller, shipments may be offered under:

EXW (Ex Works)

FOB (Free On Board)

CIF (Cost, Insurance and Freight)

CFR (Cost and Freight)

DAP (Delivered at Place)
The applicable Incoterm shall be clearly stated on the Proforma Invoice, Commercial Invoice, and shipping documents.
Under FOB terms, risk transfers to the buyer once goods are loaded on board the vessel at the agreed port of shipment.
Under CIF terms, Culturoot International shall arrange freight and insurance as specified while risk transfers according to the applicable Incoterm rules.
6. Minimum Order Quantity (MOQ)
Minimum Order Quantity requirements may apply depending on the product category, customization requirements, and manufacturer policies.
Culturoot International reserves the right to determine MOQ requirements on a product-by-product basis.
7. Production and Delivery
Production timelines are estimates only and may vary depending on:

Order volume
-
Manufacturer capacity
-
Raw material availability
-
Public holidays
-
Force majeure events
Delivery dates are not guaranteed.
Culturoot International shall not be liable for delays caused by shipping carriers, customs authorities, weather conditions, port congestion, strikes, or other events beyond our reasonable control.
8. Inspection and Acceptance
Buyers are encouraged to inspect products prior to shipment.
Upon receipt of goods, buyers must inspect products promptly and report any issues within seven (7) days of delivery.
Failure to notify us within this period shall constitute acceptance of the goods.
9. Customs Duties and Taxes
Buyers are solely responsible for:

Customs clearance charges

VAT/GST
-
Local taxes
-
Regulatory compliance requirements in the destination country
Culturoot International shall not be responsible for customs delays, seizures, additional duties, or regulatory restrictions imposed by destination countries.
10. Returns and Refunds
Due to the nature of international trade and export transactions, returns are generally not accepted unless:

Incorrect products were supplied.

Products significantly differ from approved specifications.

Verified manufacturing defects exist.
Any claim must be submitted within seven (7) days of receipt along with supporting photographs and documentation.
Refund requests shall be reviewed on a case-by-case basis.
Customized, OEM, private label, made-to-order, and specially manufactured products are non-refundable.
11. Intellectual Property
All website content including logos, graphics, text, product descriptions, images, and designs are the property of Culturoot International unless otherwise stated.
Unauthorized reproduction, distribution, or use is prohibited.
12. Limitation of Liability
Culturoot International shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our products or services.
The maximum liability of Culturoot International shall not exceed the total value of the affected order.
13. Force Majeure
Culturoot International shall not be held responsible for delays or failure to perform due to circumstances beyond its reasonable control, including:

14. Governing Law
These Terms and Conditions shall be governed and interpreted in accordance with the laws of India.
Any dispute arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Delhi, India.
